Introduction

This Terms of User Agreement ("User Agreement") lays out the terms and conditions governing the user's access and use of services on the Website/Client Desk/ Partner Desk/ Mobile Application, including any other sub-domain or platform, which is owned, developed, managed, or operated by Arth Tark (hereinafter referred to as "Website"). By using or accessing the Website and its services, the User accepts and agrees to be bound by the Terms of Use. If the User does not agree with the Terms of Use, the User may immediately exit the Website.

In terms of the Information Technology Act, 2000, this document is an electronic record, being generated by a computer system, and it does not require any physical or digital signature. Your acceptance of the terms and conditions shall be considered as your consent to use the App, the Website, the services, and products (collectively referred to herein as "Services") provided by Arth Tark in accordance with the terms and conditions laid down herein.

This User Agreement is published in accordance with Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011, which requires intermediaries to publish the rules and regulations, privacy policy, and user agreement for access or usage of the intermediary's computer resource by Users.

Interpretation

The words "him," "his," "You," "Your," "Client," "User," "Investor," "Subscriber," and "Customer" refer to the person(s) who use and avail the Services and Products of the Arth Tark Website/App and shall include both singular and plural. All headings, bold typing, and italics (if any) have been inserted for convenience of reference only and do not define, limit, or affect the meaning or interpretation of the terms contained herein.

These terms shall constitute a binding contract between Arth Tark and you when you download the App or use the services on the Website and/or the App or use its Services on any other platform managed by Arth Tark. Downloading and installing the App or using the services of the Website or the App shall be deemed to constitute sufficient proof that you have read, understood, and accepted these terms.

Any reference to any statute, ordinance, or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments, or replacements for the time being in force.

Age and Competency

Without prejudice to any other specific requirement laid out in this User Agreement, your use of the Website and the Services and your acceptance of these terms and conditions contained herein shall be deemed to be a representation from you that you are above 18 years of age, or possess legal parental or guardian consent, and are fully able, conscious, and competent to enter into this User Agreement and make your investment decisions, execute the investment transactions, evaluate the advice (if any), and confirm to abide by and comply with the terms set forth herein.

Registration and Usage

The Users shall only be allowed to avail of the Services on the Website after completing the KYC, Investment Readiness, and Information Verification process and providing complete personal information in accordance with the Know Your Client ("KYC") guidelines issued by regulatory/government agencies or authorities from time to time.

Arth Tark may use your personal information, and to provide services to you, your personal information may be processed or transferred or disclosed to third parties like statutory bodies, agencies, or third-party service providers & partners wherever necessary to enable us to provide better services to you. With your consent, your personal information consolidated during your usage of the Website/App/services of Arth Tark may be used to provide you with information, user experience, and marketing materials in relation to other products and services.

By registering with Arth Tark, enrolling as a customer, sub-distributor, or as an end investor, directly or indirectly through its sub-distributors, or as an Arth Tark Account holder through the Website, you certify that the information you provide is accurate. Arth Tark reserves the right, in its sole discretion, to deny you access to the Website or any portion thereof without notice for the following reasons:

Unauthorized access or use by you

If you assign or transfer (or attempt the same) any rights granted to you under this User Agreement. If you violate any of the terms and conditions of this Agreement. The termination or cancellation of this Agreement shall not affect any right or relief to which Arth Tark may be entitled at law or in equity. Upon termination of this Agreement, all rights granted to you will terminate and revert to Arth Tark.

License

Arth Tark hereby grants you a limited, non-exclusive, non-assignable, and non-transferable license to access the Website provided and expressly conditioned upon your agreement that all such access and use shall be governed by all the terms and conditions set forth in this Agreement.

Investment Risks

There are significant risks associated with an investment in any products or services provided by Arth Tark. Investment in the products and services is intended only for those investors who can accept the risks associated with such an investment (including the risk of a complete loss of investment), and you should ensure you have fully understood such risks before taking any decision to invest.

Proprietary Rights & Copyrights

All rights, title, and interest in the Website and any content, as well as the design and information contained in the Website, are the exclusive property of Arth Tark, except as otherwise stated. Arth Tark is the sole owner of all the intellectual property, including all rights in trademarks, logos, symbols, reports, patents, and designs.

The Website is only for your personal and non-commercial use. Nothing in this Agreement shall be construed as transferring or assigning any ownership rights to you or any other person or entity.

Jurisdiction

The usage of the Website and the terms of this User Agreement are exclusively based on and subject to Indian laws. The User hereby consents to the exclusive jurisdiction and venue of courts in India in all disputes arising out of or relating to the use of the Website.

Changes to Terms and Conditions

Arth Tark has the absolute discretion to amend or supplement any of the terms of the Website at any time. The User shall be responsible for regularly reviewing these terms, including amendments thereto as may be posted on the Website. Continued use of the Website shall be considered acceptance of any modifications.
